Did you know that over half of all Australians pass away without a will? 

You can't control how NF affects you or your child, but you can do a lot to ensure they're taken care of if the unthinkable happens. Estate planning is about more than just deciding how your assets will be distributed when you pass away,  it is also a roadmap for loved ones to follow should you be unable to make decisions regarding your finances or health.

MEET OUR Guest Speakers

Ellen Pacelli

Ellen Pacelli is an experienced solicitor at Owen Hodge Lawyers and has focused her expertise on Estate Planning, Deceased Estate Administration, and Estate Litigation.

The Children’s Tumour Foundation is very close to Ellen’s heart as her son Remo has Neurofibromatosis Type 1 (NF1). 

Over the years, Ellen and her family have connected with the CTF, attending camps and community days. Remo is currently in a stable condition with NF1, however like many people with a genetic condition, Remo has had multiple surgeries and is continuously required to be monitored by various different specialists.

The unpredictable nature that is NF, has all the more highlighted to Ellen the importance of the work she does. She wants to take this opportunity to give back to the community and ensure your estate planning process is as simple and stress free as possible.

While being admitted in both the New South Wales Supreme and High Court of Australia, Ellen has many years’ experience over many facets of law including criminal, traffic law (while prosecuting for the Road Maritime Services RMS) property and estate law.

Since being with Owen Hodge Lawyers, Ellen has focused her energy on her favourite area of law being Estate Planning, Deceased Estate Administration, and Estate Litigation. Ellen is drawn to this area of law because of her personal experiences within it, which provides her another level of understanding and provides further benefits to her clients on how to deal with their matters.

On a personal level, Ellen lives with her partner, IT guru Jason. Together they live with Jason’s daughter Kristina and Ellen’s son Remo.

Due to Ellen’s personal life experiences, including being involved in a blended family and caring for a child with NF1, Ellen understands the importance of estate planning and how planning for your families future now can best support your loved ones.

Having a child with a genetic condition is a stressful and painful journey, however it is always Ellen’s mission to ensure that getting your estate planning in order is made as simple and stress-free as possible.

Dr Malcolm Stoddart

Dr Mal Stoddart is a solicitor and academic with expertise across estate planning, special disability trusts and Supreme Court Equity matters, as well as experience:

  • Academically across theology and law
  • Lecturing at the University of Wollongong in Wills and Succession (Estate Planning)
  • Chairing two private schools through major intensive growth phases
  • Establishing as CEO a charity

Mal commenced practice on his own account at the age of 24 in Wollongong where he grew his practice exponentially. With another three lawyers of his generation, his primary concern was the change to a service focus rather than the traditional stodgy professionalism of the day. In day to day practice, his primary service area was 'business structures and trusts'. He established numerous service trusts for the medical profession, and a large general and conveyancing practice.

Mal returned to the law some 16 years ago and has focused on what is called 'Estate Planning' including;

  • Testamentary Trust Wills for tax minimisation and asset protection
  • generational and wealth creation
  • disability trusts
  • special trusts to give added protection against claims in the Family Court
  • end of life documents expressing your wishes, and
  • Will contests including Family Provision matters and will construction.

If you or your child has a chronic or genetic condition like NF, it can be really important to plan ahead. Planning ahead means that if something were to happen, they will be taken care of in the way that you decide is best, rather than leaving it to be dealt with by an arbitrary legal system.

Ellen is also a Mum to NF Hero, Remo.  Remo has NF1.

Being part of a blended family, while also caring for a child with NF, means that Ellen understands how important it is to plan for your families future now in order to best support your loved ones later.
